Texas Marriage License — General Requirements
Both applicants must appear in person
at the County Clerk or JP office.
Residency:
There are no residency requirements. Both residents and non-residents can apply to be married in The Lone Star State.
Acceptable IDs:
acceptable identification includes a driver’s license or identification card issued by the state or another state that is current or has expired not more than 2 years, a U.S. passport, a current passport issued by a foreign country or a consular document issued by a state or national government (a matricula consular from Mexico is not acceptable), an unexpired Certificate of US Citizenship, US Citizen Identification Card, Permanent Resident Card, Temporary Resident Card, Employment Authorization Card, or other document issued by the federal Department of Homeland Security or the US Department of State, an unexpired military identification card, and original or certified copy of a birth certificate issued by a bureau of vital statistics for a state or a foreign government, a voter registration certificate, a pilot’s license, a license to carry a handgun, etc.
Waiting & Validity:
72hour waiting period before the ceremony (can be waived for military or premarital education), license valid for 90 days
Return:
Officiant must return signed license within 30 days. If the couple returns the marriage license, the license will be recorded by the county clerk’s office and handed back to the couple the
SAME DAY.
Pricing:
Varies by county clerk office. Approximately $75 - $88 for residents. Most offices accept card/cash, but if taking cash (exact cash is recommended).
